TERMS AND CONDITIONS

ETS India Private Limited (“ETS India”) is conducting the “TOEFL INDIA Championship 2024” (the “Contest”). The Contest consists of two levels i.e., Round 1 and Round 2, wherein the participants would get a chance to win a Cash Prize (defined below) in Round 1 and/or a Grand Prize (defined below) in Round 2 (collectively referred to as the “Prizes”), in accordance with the following terms and conditions (“T&Cs”):

Eligibility:

The following criteria shall be met by each participant to be eligible for the Contest:
  • Citizenship: The participant must be a citizen of India holding a valid passport to participate in the Contest.
  • Offer Period: Round 1 of the TOEFL INDIA Championship shall be open from 5th April 2024 to 31st Jul 2024 and Round 2 for the Grand Prize shall only be open for the TOEFL iBT® test takers who registered and took the test during the period from 5th April 2024 to 31st July 2024.
  • In case of the participant being a student, he/she must be currently enrolled in the third, or fourth year of an undergraduate degree program at an accredited Indian Higher Education Institution i.e. a college or university. Whereas, students who have completed their undergraduate or graduate studies in India and looking for higher education abroad. Further, if the participant is a professional, he/she must have up to two (2) years of verifiable professional work experience.
It is hereby also clarified that the successful completion of Round 1 by the participant of the Contest with a minimum percentage of 35% is mandatory to be eligible to participate in Round 2.

Prizes:

  • ETS India shall declare the winners of Round 1 of the Contest within 15 days and cash prizes will be distributed within 30 days of concluding Round 1. For Round 2 of the contest, winners will be declared in 30 days of the late day of Round 2. The grand prizes will be disbursed within 15 days of receiving all necessary documents which include the admission offer from a foreign university and valid id proof among other details. (“Winner”). However, no such requests for grand prize will be entertained if the documents are not received based on the last date communicated by ETS India for submission of documents.
  • Cash Prizes for Round 1: A total of Rs 4 Lacs will be distributed amongst the winners in the following manner:
    • 1st (1 winner): ₹50,000
    • 2nd (2 winners): ₹40,000 each
    • 3rd (3 winners): ₹30,000 each
    • 1st Runner Up (4 winners): ₹20,000 each
    • 2nd Runner Up (10 winners): ₹10,000 each
  • Grand Prizes: The participants who complete Round 1 and further score a minimum of 75 marks in the TOEFL iBT® exam shall be eligible to win the Grand Prizes in the following manner:
    • Grand Prizes (Total - ₹11,00,000):
    • 1st (1 winner): ₹2,50,000
    • 2nd (2 winners): ₹2,00,000 each
    • 3rd (3 winners): ₹1,50,000 each

    For the purpose of better understanding, it is hereby clarified that the participants taking part in Round 1 of the Contest, whether winning the Cash Prize thereunder or not, shall be eligible for participation in Round 2 of the Contest if they have scored more than 35% in Round 1.

    Selection Criteria:

    • Round 1 Cash Prizes Selection: Round 1 cash prizes aggregating to ₹4 lakhs will be selected solely based on the scores achieved in the designated Round 1 quiz. This includes both the overall score and individual time taken to complete the round 1 quiz.
    • Round 2 Grand Prizes Selection: Round 2 grand prizes aggregating to ₹11 lakhs will be selected based on scores achieved in the TOEFL iBT test. This includes both the overall score and individual section scores across Reading, Listening, Speaking, and Writing in case of a tie in the overall score.
    ETS India shall disburse the Cash Prize for Round 1 and/or the Grand Prize for Round 2, as the case may be, in Indian Rupees (INR) only and directly to the Winner’s designated bank account as provided in advance (through a canceled cheque), by the Winner in writing through an e-mail to ETS India at register4toefl@etsindia.org.

    Winner’s Obligations:

    • Academic Performance: As a recipient of the Grand Prize, the Winner is expected to maintain a good academic standing throughout his/her studies abroad.
    • Promotional Activities: The Winners of the Cash Prize and/or the Grand Prize, as the case maybe, will participate in the promotional activities for TOEFL® as and when requested by ETS India.
    • The Winners will be required to act as a TOEFL Brand Ambassador and share static and video testimonials and record two of his/her videos on campus at a foreign university that he/she has joined.
    • The Winner may also be required to promote TOEFL amongst his/her network.

    Additional Terms and Conditions:

    • Post taking the TOEFL test, a participant shall use the following link to apply for the grand prize of Round 2: https://www.etsindia.org/toefl-india-championship/registration-round2
    • A participant shall be eligible to win this Contest only once. Any subsequent wins of the participant will automatically be deemed void.
    • In case a participant becomes eligible for more than one scholarship, grand prize, etc. by whatever name called, by ETS India during April 2024 and Sep 2024, the participant will be eligible for only 1 such grand prize or scholarship which is of the higher value.
    • By participation in the Contest, it shall imply that participants agree to all the T&C’s mentioned herein. Any participant found using any unfair means anytime during the Contest will be immediately disqualified at the sole discretion of ETS India. ETS India reserves the right to take appropriate legal action against the participant in case of any violation of applicable laws.
    • Participation in the Contest is wholly voluntary and by participating in the Contest, the participants agree to receive communication(s) from ETS India relating to the Contest and the participant unconditionally agrees not to make any claims or raise any complaint against ETS India in this regard.
    • Winners shall be allowed to claim the Prizes only upon proper submission of all relevant details/documents for review in the manner that shall be communicated by ETS India. In case the Winner fails to furnish the details/documents on or before the date designated by ETS India for this purpose, or accept delivery of the Prize, the Winner shall be deemed to have surrendered the Prize. In such case, ETS India reserves the right to offer the Prize to the next suitable participant.
    • All taxes, levies, and duties due and owing under applicable and statutory laws in connection with all Prize if any, and all other costs, including insurance, incidental costs, gifts, gratuities, and taxes, are the sole responsibility of the Winner(s).
    • The Prizes under the Contest shall be non-transferrable.
    • ETS India reserves the right to cancel, modify, alter/amend extend, or withdraw the Contest and its terms at any time at its sole and absolute discretion.
    • Participants agree that ETS India shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession, or use of any Prize.
    • It is also hereby clarified that the conduct of this Contest shall not fall under the definition of “lottery” as defined under the Lotteries (Regulation) Act, 1998
    • ETS India shall be entitled to use the database of the entries received and/or any personal data included as part of such database, including test-taker data and information in accordance with the ETS India Privacy Policy (accessible at Privacy Policy - ETS India) for the purposes and in the manner outlined in the ETS India Privacy Policy, including, without limitation, for future promotional, marketing and publicity purpose without any further reference or payment or compensation whatsoever to the participant.
    • ETS India shall not be held liable for delays or any issues in connection to the distribution of the Prize.
    • The Contest shall be governed by and construed in accordance with the laws of India.
    • Subject to para below, all disputes hereunder shall be subject to the exclusive jurisdiction of courts at New Delhi, India only.
    • Any disputes, differences and, or any other matters in relation to and arising out of the Contest and, or, pertaining to the rules and regulations and, or, the T&Cs shall be referred to arbitration under the Arbitration & Conciliation Act, 1996 as amended from time to time. The arbitral tribunal shall consist of a sole arbitrator to be appointed by ETS India. The seat and venue of arbitration shall be New Delhi.
